Against Opera singer from North Ossetia Vadim Cheldiev prosecuted for “extremist” article 280 of the Criminal code – the consequence considers that through blogs on the Internet, he extended the appeals to the past April 20, unsanctioned rally in Vladikavkaz. Rosfinmonitoring has included Cheldiev in the list of suspected extremists. MK said that means the inclusion in this list.
Vadim Cheldiev was arrested in St. Petersburg and is now sitting in jail Pyatigorsk. He was involved in two criminal cases. One was opened under part 1 of article 318 of the criminal code (violence against a representative of authorities not dangerous for life and health of this most representative): during the arrest, according to investigators, the singer had resisted the law enforcement officers. In the same article, incidentally, was condemned by some participants in unauthorized mass actions that had taken place in the summer of 2019 in Moscow. And another case was opened for a new article 207.1 of the criminal code for dissemination of knowingly false information about the epidemic and ways to combat it, resulting in serious consequences.
And now – part 2 article 280 “public calls for extremist activities”, distributed through the media and the Internet, and inclusion in the list of suspected extremists.
“MK” talked to lawyer Ivan PAVLOV that means inclusion in the list.
— There is a measure that is before the court allows a person to assign a certain status in the flawed civil rights. He cannot be the founder NGOs, media… But in everyday terms the main thing – that blocked all the accounts. It is very sensitive immediately, especially if the person all the accumulation was on the card, and imagine that his whole family, it turns out, is suffering.
Who makes the decision on inclusion in the list?
– does its own Rosfinmonitoring, without any judicial procedures. If the investigation has opened a case on the “extremist” article of the criminal code, it happens almost always.
But if the citizen in the end will not be recognized as extremist, account unlocks?
– the fact that the procedure for removal of the status was never set in stone. In practice this means: if the case against the man to stop – he was removed from the list. Or when a record is removed.
– a man will serve their sentences, and then another few years until overturned his account will be blocked?
– Yes. Unfortunately, so.
