A bill to pilot legal regimes — it is, recall, is for a local deregulate in conducting technological experiments (like the release on the streets some territories in the unmanned taxi) — passed first reading in the state Duma. However, the document was criticised by legislators, requiring details have not yet introduced the experimental regimes, and concerns of expanding the powers of government in their regulation. The economy Ministry has already begun to develop amendments — the Agency should submit them within two weeks. However, further passage of the project may be delayed because of the pandemic, although the deputies and recognize the relevance of the project. The state Duma adopted in the first reading the bill on the pilot legal regimes (EPR) — “the regulatory sandbox” designed to simplify the implementation of innovations at the expense of removing them under General regulations in certain territories. The project was planned for adoption in spring of 2019, but hung over the disputed norms on the right of the government to apply targeted exemptions from legislation for EPR. This would mean granting the White house the powers of the legislators (see “Kommersant” on 18 may 2019). Subsequently, the rule was reinterpreted, in General, the decision on the possibility of exemptions to be adopted by Parliament and the government to apply them in specific cases (see “Kommersant” on March 18).However, and as such, the rule raised concerns of legislators: because the experimental modes themselves will be regulated by the normative legal acts of the government, a number of deputies asked to ensure the participation of the state Duma and in their development. Other MPs insist that the second reading of the White house has submitted to the Duma regulations, obviously ignoring that in this case, the principle of separation of powers is violated already by the intervention of legislators in Executive powers. However, as reported by “Kommersant” in the Ministry of economy, the Ministry has already started to develop regulations. In General, the project will require technical amendments. It follows from the conclusions of the legal Committee of the state Duma, updates require the concept of “experimental legal regime”, “General regulation” “special regulations” etc. In finalizing needs and subjective part of the regulated relations — now under “the participants of the EPR” refers to his entities, and other persons (e.g., consumers of pilot services). MPs are recommended to rely on the experience of Moscow, where the ESR have already introduced for the implementation of artificial intelligence and under the participants of the experiment refers exclusively to persons engaged in specially regulated activities. Participated in the development of the project senior expert, CSR and project Manager CPU Olga Shepeleva indicates that the subjects and other participants of the experiment, and so divided in the project. “In particular, the first describes the requirements and duties, and for the second provides a number of safeguards, including informing about the features of the experiment and participated in the experiment, only with informed consent,” she said.Note that the project on “regulatory updates” was caused by the need for unification of regulatory framework of experiments tech companies, otherwise it will replace the controversial case of regional laws, giving local experimental modes. MPs recognize the relevance of the introduction of “legal sandbox”, especially against the background of the pandemic. However, it can also become a reason for delaying consideration of the project: Chairman of the state Duma Vyacheslav Volodin recommended to focus on project work to support business and citizens. Such projects as the introduction of EPR may require additional discussions.Diana Galieva
