Four residents in Hays County, Texas recently took legal action against the Hays County Commissioner Court regarding the transportation bond election, known as Proposition A, which was approved in August. The decision to move forward with the bond election was made by the Commissioners Court with a 5-0 vote, allowing for approximately 30 transportation projects to be carried out by increasing the county tax rate by $0.02 per $100 valuation, equaling to about $80 per year for a $400,000 home.

The individuals filing the lawsuit argue that the Commissioners Court violated the Texas Open Meetings Act by not providing specific details about the bond package. According to Les Carnes, one of the plaintiffs, the bond proposal was put together in secrecy without proper public notice, depriving residents of the opportunity to participate in the decision-making process. The lawsuit also highlights concerns about certain projects included in the bond package that could impact environmentally sensitive areas like the Edwards Aquifer Recharge Zone.

Bobby Levinski, an attorney with Save Our Springs, expressed surprise at the lack of transparency surrounding the bond package and the absence of detailed information for the public. He emphasized the need for more clarity and public involvement in shaping the bond package. The plaintiffs are seeking for a judge to nullify the election, appoint a bond advisory committee, and schedule a new vote in 2025 to ensure greater transparency and public input.
