the Man in the 50’s is also ordered to pay 250.000 dollars in damages to Jan Helge Johansen.

on the Night of Saturday 10. november 2018 had samboerparet Jan Helge Johansen and Elisabeth Sjøvoll been out on the town in Svolvaer together with a friend.

– I was completely numb in the thigh and watching the blood spurt out. The foot is located in a completely wild angle, then I understand that the leg is shot on the contrary, Johansen told.
He had two operations to get on his feet again. After having been cleaned, splints, he was sent to the University hospital of North Norway in Tromsø, where he was operated.

He had lost a lot of bone tissue and the result was not entirely successful. In February 2019, he had to again lie on the operating table.
According to an assessment from a rettssakkyndig doctor in the aftermath hit the ball just a half a centimeter away from the main artery in the thigh. Had it hit the main artery, is the doctor’s assessment that he would have been dead in a short period of time.
Siktedes defender says his client refutes that he intended to kill Johansen.
Want to appeal
the Man in the 50’s declared himself not guilty of the charges.
He admitted to have fired the shots, but claimed to have aimed at the thigh of his friend. He acknowledged, therefore, to have suffered by his friend, the rough kroppsskade.
the Court believed, nevertheless, that the man only acknowledged it appeared as obvious, and believe that the confessions should not have any significance in mitigating direction.
My client disagrees with the verdict and will appeal, ” says the man’s defence counsel, Mette Yvonne Larsen to NRK.
– He emphasises that his intention was to scare, he has admitted that the shot was loosened but not to kill, ” she says.
Larsen believes, therefore, that the judgment is wrong.
– the Court has assessed the evidence incorrectly and not taken into account the doubt, ” says Larsen.
the Prosecutor Thor Erik Høiskar says that the judgment is in line with what he expected.
– It is a good and thorough judgment, and all the way down, in detail, the court has agreed that we wanted to prove.
– We’ll see what happens. The pity is that I never get finished with this when the judgement subject to appeal, ” says Jan Helge Johansen.
Old militærpistol
During the trial it was revealed that the gun that was used, an old belgian militærpistol that he had home with them after the UN-service, had a malfunction with one of the magazines.
This error led to a new shot was not taken into the chamber of the gun, but the gun clicked when trying on the new firing.
the Man explained that he had taken out the magazine from the weapon and clicked with it without sharp shots.
When the police demonstrated the gun in court it was revealed that this would not be possible, since the gun had a fuse that makes it impossible to pull off without the magazine in place.
