The Federal network Agency of Germany BNA rejected the application of Nord Stream AG 2 from the release requirements of the EU gas Directive. The regulator found unconvincing the arguments about cost functional completion of the project and billions of dollars of investment before the adoption of the new standards, noting that technically the project was not completed by may 23, 2019. In fact, it means that “Nord stream-2” cannot be run at full capacity. Nord Stream AG until 2 evaluates the decision and plans to study measures for the protection of their rights. The Federal network Agency of Germany (BNA) rejected the application 2 Nord Stream AG with a request to release the “Nord stream-2”, which is operated by the company, from the requirements of the updated EU gas Directive, as stated in the decision of the BNA.”Seventh panel (BNA) on 15 may rejected request 2 Nord Stream AG exemption which runs in the German sovereign waters part of the “North stream-2″ from regulation (according to Directive)”,— specified in the message (quoted by TASS). Condition for exemption from the requirements among other things could be the completion of the pipeline to may 23, 2019, but “in the case of “Nord stream-2″ is not so”, said controller.2 Nord Stream AG took note of the information on the website of the Federal network Agency of Germany about the refusal of a request for release, said a statement. “The regulator considers that the gas pipeline “Nord stream-2” did not meet the criterion of “project completion” to may 23, 2019 in accordance with article 28b, paragraph 1, item 1 of the Federal law on energy economy of Germany,— it is told in the company message.— Nord Stream AG 2 did not agree with this decision and argues that the effective date may 23, 2019 the pipeline was completed from the point of view of economic functionality.””International legal experts have confirmed that the narrowing of the definition of “project completion” prior to the conclusion of the physical construction of the pipeline will violate the protection of legitimate expectations and other fundamental rights in EU law, says the company.— It is also contrary to the constitutional guarantees of the Basic law”.At the end of 2019, the German Parliament urgently adopted the law, otdihali to the “Nord stream-2” the commissioning of the project until may 24, 2020. It was an opportunity for Gazprom to comfortably complete the construction, but after the U.S. imposed sanctions against companies that provide services for laying of pipeline, therefore the Swiss Allseas refused to strip of the last section. In early may, the German newspaper Handelsblatt, citing a draft decision of the Ministry wrote of the rejection of the corresponding application, Nord Stream AG 2 (see “Kommersant” on may 1).
